Under the circumstance of the proceeding two paragraphs , where the debtor has a circumstance provided in the first paragraph of article 3 of this law , the peoples court shall make a simultaneous decision on declaring the debtor bankrupt except that the debtor or the creditor applies to solve debts through a way of conciliation before bankruptcy declaration 在前二款规定的情况下，债务人具有本法第三条第一款规定情形的，人民法院应当同时作出宣告债务人破产的裁定。但是，在破产宣告前，债务人或者债权人申请以和解方式清理债务的，不在此限。
