• Article 13 where requesting the customs to detain the suspected infringing goods , the holder of the intellectual property right shall present a written application and relevant evidentiary documents , and provide as well any evidence that sufficiently proves the obvious existence of the fact of infringement
  第十三条知识产权权利人请求海关扣留侵权嫌疑货物的,应当提交申请书及相关证明文件,并提供足以证明侵权事实明显存在的证据。
• Article 15 where the holder of an intellectual property right has applied for detention of the suspected infringing goods in conformity with the provisions of article 13 of these regulations and provided a security in conformity with the provisions of article 14 of these regulations , the customs shall detain the suspected infringing goods , notify the holder of the intellectual property right in writing of the detention and serve the consignee or consignor with a customs detention receipt
  第十五条知识产权权利人申请扣留侵权嫌疑货物,符合本条例第十三条的规定,并依照本条例第十四条的规定提供担保的,海关应当扣留侵权嫌疑货物,书面通知知识产权权利人,并将海关扣留凭单送达收货人或者发货人。
• Article 20 where the holder of an intellectual property right requests the customs to detain the suspected infringing goods after the customs discovers the import or export goods suspected of infringing the intellectual property right under customs recordation and notifies the holder of the intellectual property right of such suspected infringement , the customs shall carry out an investigation and make , within 30 working days from the date of detention , a determination as to whether the suspected infringing goods under detention have infringed the intellectual property right ; in case the determination cannot be made , the customs shall immediately notify the holder of the intellectual property right in writing
  第二十条海关发现进出口货物有侵犯备案知识产权嫌疑并通知知识产权权利人后,知识产权权利人请求海关扣留侵权嫌疑货物的,海关应当自扣留之日起30个工作日内对被扣留的侵权嫌疑货物是否侵犯知识产权进行调查、认定;不能认定的,应当立即书面通知知识产权权利人。
• Where the holder of an intellectual property right requests the customs to detain the suspected infringing goods , the customs can not determine that the detained suspected infringing goods have infringed his intellectual property right or the people ' s court adjudicates that there is no infringement of his intellectual property right , the holder of the intellectual property right shall bear liability for compensation according to law
  知识产权权利人请求海关扣留侵权嫌疑货物后,海关不能认定被扣留的侵权嫌疑货物侵犯知识产权权利人的知识产权,或者人民法院判定不侵犯知识产权权利人的知识产权的,知识产权权利人应当依法承担赔偿责任。
• In case the holder of the intellectual property right presents an application in conformity with the provisions of article 13 of these regulations and provide a security in conformity with the provisions of article 14 of these regulations within three working days from the date of service of the notification , the customs shall detain the suspected infringing goods , notify the holder of the intellectual property right in writing of such detention and serve a customs detention receipt on the consignee or consignor
  知识产权权利人自通知送达之日起3个工作日内依照本条例第十三条的规定提出申请,并依照本条例第十四条的规定提供担保的,海关应当扣留侵权嫌疑货物,书面通知知识产权权利人,并将海关扣留凭单送达收货人或者发货人。
• If hand - carried exhibits are detained by the airport customs office , cietc may handle the customs declaration ( in temporary basis ) with a detention note issued by the customs office and collect back the goods from beijing airport ( may take 2 working days , and the charge will be the same as inbound air - freight shipment )
