It firstly analyzes the theoretical basis to distribution of proof burden and states the reasons of the distribution ; and then on the basis of the theoretical proof legal conduct , this paper tries to testify the nature of the distribution of proof burden ; and finally to form a new system from the perspective of the theory of legal hermeneutics 分析了举证责任分配的理论依据，阐释举证责任分配的理由；运用法律行为的相关理论证明举证责任分配的实体法解释的本质；从法律解释学的角度重新构造了举证责任分配。
