According to different standards , we can divide prolonged detainment into two categories . according to the conditions and limitation of the rules of the criminal procedure , there are evident prolonged detainment and converted prolonged detainment ; according to the criminal procedure , there are prolonged detainment during investigation period and prolonged detainment during prosecut - ing period and prolonged detainment during trial period and mixture prolonged detainment 根据刑诉法规定的条件和期限，超期羁押分明显的超期羁押和变相的超期羁押；根据刑事诉讼活动程序，超期羁押分侦查阶段的超期羁押、起诉阶段的超期羁押、审判阶段的超期羁押、混合型的超期羁押四种形式。
