So in the face of the actul problems in environment and resource in our country , we have to set up a legistation ideology of sustainable development , revise current consittution , environment protection law , other laws and regulation related with enviroment and resource , build up a full and complete nature resource fundamental law , energy fundamental law and other professional laws , optimaze resource and enviroment legistation system , as well as environment and resources surveillance management system , environment resources law fundamental system 因此针对目前我国环境与资源立法存在的实际问题，必须要确立可持续发展的立法指导思想，修改我国宪法、环境保护法及有关环境与资源的法律、法规，制定统一的自然资源基本法、能源基本法及其他专门性法律，完善环境资源立法体系，同时完善环境资源监督管理体制和环境资源法基本制度。
After analyzing and researching , i think we should build our country ' s basin management legislation in following ways : firstly , we should define concept and corresponding legal norm on " basin manage " in environmental protection law , water law , etc . secondly , we should make out " basin manage law " and define basin management ' s status , duty , authority of organization to guarantee on the powerful centralized management and the scattered administrative division management . thirdly , we should make out the special basin management rule to every great rivers and lakes , especially to the changjiang river , and the yellow river . fourthly , we should perfect the relevant auxiliary law and legal system 通过比较和分析研究后，如下建构我国的流域管理立法体系：第一，在《环境保护法》 、 《水法》等法律中明确“流域管理”的概念及相应的法律规范；第二，制定《流域管理法》 ，明确流域机构的地位、职责、作用、权限、编制，确保在强有力的集中管理既流域管理下，辅以分散的行政区域管理；第三，对于各大江大河流域，结合各自的实际情况，或制定专门的法律如《长江法》 、 《黄河法》 ，或制定专门的流域管理条例，或制定地方水法规；第四，健全相关配套法规及相关法律制度。
In china environmental tort law system in modern sense has already , the forms of it are constitution law , civil law , environmental protection law , interpretation of law , etc . china ocean environmental protection law ( 1982 ) has established the criterion of liability without negligence , the requisites to constitute an environmental tort are injurious act , damage , causation , etc . among of them injurious act is the prerequisite of environmental tort 我国环境侵权法的无过失责任原则最先是由《海洋环境保护法》确立的。环境侵权的构成要件有行为的违法性(侵害行为) 、损害事实、侵害行为与损害事实之间的因果关系等三个条件构成的。其中行为的违法性(侵害行为)是构成环境侵权的前提，因为合法行为不能引起民事责任的产生。
