Danger in criminal law , as a basic theoretical issue in normative criminal law , always attracts enough attentions from the native and foreign scholars , different theories about it are massive and disagree with each other . the phenomenon reflects that the issue is profound and the criminal theories are abundant and extensive . but the related theories are so complicated and confusing as to make troubles and confusions to judicial practice , and the condition is disadvantage to construct and develop the criminal subject 本文通过对危险概念的相关分类的分析,提出了“理论推定的危险? ?规范性的危险”这一分类,并且在这一分类的框架之下,对未遂犯的危险、抽象危险犯的危险与具体危险犯的危险的内容与判断构造做了简要的分析,提出了自己的观点。
This article puts forward the classification of “ danger of theoretical assumption ? normative danger ” through the analysis of classification related to criminal law , furthermore under the classification frame , the author briefly analyzes the danger of attempted offense , contents and judgment structures between the danger of abstract offense and concrete offense , hence put forward his own opinions and hope that the article can contribute to the research on danger in criminal law and judicial practice 笔者认为,从二元的行为无价值论的立场来讲,未遂犯的危险是指以行为时存在的行为人特别认识到的以及一般人认识到的客观事实为基础,根据社会一般人的标准进行判断,行为本身所具有的侵害保护客体的一般的抽象的可能性。关于抽象危险犯,笔者主张在形式说的立场上取“一般的危险说” 。
Firstly , based on the analysis of different concepts in different countries , the author points out that the differences between them are due to their different understandings and various social backgrounds . secondly , the author puts forward his concept on impossible crime . thirdly , he lays out three characteristics , and then gives deep and detailed analysis about it 本部分首先通过对各国不能未遂犯概念的分析,指出之所以会出现这样的差别,是由于各国对不能未遂犯的不同理解和各国不同的社会背景,并在此基础上提出了笔者的不能未遂犯的概念;其次在提出了不能未遂犯的概念以后,笔者又根据不能未遂犯的概念提出了它的三个特征(着手实行性、既遂不能性、行为危险性) ;最后对不能未遂犯的三个特征作了深入和详细的解析。
