In the second part of this treatise , the author argue the stranger dissent of our country . in our country , the legislation is short of the lawsuit of the enforcement because of limits of many thing . the function of the lawsuit of the enforcement is replaced by the stranger dissent and re - trial in civil procedure . the author thinks that is agaist to the value of fair and efficiency 由于立法之初种种条件的限制，我国事实上缺乏异议之诉，它的功能在某种程度上由案外人异议制度和再审制度来承担，这造成了对公平和效率价值的违背，使权利不能得到全面彻底的保护，也将再审制度引入歧途。
