This paper illnstrates wide - ranging education view , wide - raging course view , teaching equality view , goal - triunity view and blended - valuing view , which are all aimed at dealing with the problems in the reform 本文就适应课程改革应树立的大教育观、大课程观、教学平等观、三位一体目标观、多元评价观进行了阐述。
The first is that we should not only value the laws that stress the equality but also value if man and woman have aquired the real equality ; the second , there are three kind of rights - due rights , legal rights and real rights . the last one should be paid more attention ; the current laws should in accordence with the resulting equality and essential equality . on the reconstructed equality idea , the writer tried to construct a theorical framework which has two charcters on equality and made it as a criterion for the laws and policies 应该构建新的男女“区别对待”的平等观:即首先不仅重视男女平等的法律规定,更应该重视法律实施后男女是否获得了“结果的下等” ;其次,在权利的三种基本形态“应有权利” “法定权利”和“实有权利”中,应更重视女性“实有权利”与男性的平等,以“结果的下等”和“实质的平等”为尺度调整现行的法律政策。
The second part pointed that the traditional understanding of right would lead to the misunderstanding that only the absolute equality is the real equality . the writer made a jurispudential research on the misunderstanding of absolute equality and then pointed that there are physiological differnces and social defferences between man and woman . this paper also said that we should construct a new equality idea which has two parts 第二部分指出对权利进行传统的理解易走入“男女绝对一样才是平等”的误区,笔者从法理学入手,论述进入“绝对平等”误区的原因,指出传统平等观在进入既有生理差别,又有社会性别差异的男女平等的问题时,是不适宜的。
This paper began from the definition gender and analyzed the traditional concepts of equality and tried to explain that the former what - is - called equality wrong point of view which wanted to efface the existing difference between man and woman and wanted to get the absolute equality . with the help of some postmodern terms and views , the writer tries to descontruct the traditional mode of equality and tries to take advantage of the individual characters of man ' s and woman ' s to make them can enjoy differential equality on the basis of admitting the i nfluence of gender on man and woman . the writer also suggests that the party that take more duties or lossed because of the differential equality should be compensated by the government through the laws , policies and economic approaches 然而,现实生活中,女性得到的平等权仍是形式上的平等,离真正的男女平等还相差甚远,造成此现象的原因是多方面的,本文仅从“社会性别”这一概念入手,通过对传统平等观的剖析,说明以往的平等权是一种企图抹杀客观存在的男女性别差异和社会性别的影响,要求男女绝对一样的平等的错误观点,笔者借助后现代主义的部分观点试图解构这种传统固定的平等模式,以期在承认社会性别对男女影响的基础上,发挥、利用男性与女性各自的优点和特点,对其实行有差别的平等,对由于实行“有差别”的平等给女性(或男性)造成的损失或对多承担义务的一方,国家从法律、政策、经济等多方面对受损害者和多承担义务者给予救济,以此达到女性平等权的真正实现。
On the other hand , facing up to the reality and based on equal opportunities of compulsive education stage , we should combine educational reform with social reform in the practice of reform , change educational environment of disadvantaged groups in underdeveloped areas , alter management system concerned with national expenses of equality in the thoughts of teachers and education managers must be strengthened effectively , then in order to improve inner environment of education greatly 另一方面,要正视现实,寻求变革,并将教育改革和社会变革相结合;立足于义务教育阶段实现教育机会均等;切实改变贫困地区和不利群体的教育环境;改变教育经费的管理体制,加大国家投入的力度与分配上的倾斜度。同时,还要切实加强教师和教育管理者的平等观建设,优化教育内部环境。
