This paper has explained the legal basis for the old foreign trade proxy system before the contract law was issued and its main defects by tracing the conception of proxy , proxy system and the forming process of our foreign trade proxy system . through the analysis of the clauses corresponding to the foreign trade proxy system provided in the contract law , this paper illustrates the role the contract law has to promote our foreign trade proxy system , discloses the problem we are still facing at present , predicts the future of our foreign trade proxy system and puts forward some concrete suggestions and necessity of bettering our foreign trade proxy system further 本文追溯了代理概念、代理制度以及我国外贸代理制度形成的过程，阐述了新合同法颁布前我国外贸代理制度的法律依据及其主要缺陷；通过解析新合同法中外贸代理的相关条款，阐释了新合同法对我国外贸代理制度的推动作用，揭示了目前我们仍然面临的问题，并展望了我国外贸代理行业的发展前景，近而提出了进一步完善我国外贸代理制度的必要性和具体建议。
