The behavior of plagirizing other ' s literary or artistic work shoud not be regarded as crime . the behavior of illegally renting other ' s literary or artistic work and copies shoud be prohibited by ciminal . in the present criminal law of our state , the provision about the behavior of passing off other ' s trademark need not modify and the scope of the prohibition of the passing off other ' s trademark by the criminal law is suitable and reasonnable 在我国知识产权刑法调整范围的具体评价中，作者认为：不宜将“剽窃、抄袭”他人作品的行为在立法上升格为犯罪；应当将非法出租他人作品及复制件的行为纳入刑法的调整范围，但应从行为对象、主观意图、出租规模等要素上加以严格限制；假冒他人注册商标的行为方式应当维持目前刑法的规定，没有必要将其扩展到其它侵犯注册商标专用权的行为上来。
